Terms of Service

The agreement that governs your use of Webance.

These Terms of Service ("Terms") form a binding agreement between you ("Customer", "you") and Webance ("we", "us", "our"). By submitting an inquiry, creating an account, or making a payment, you confirm that you have read, understood, and accept these Terms and our Privacy Policy.

1. The service

Webance is a done-for-you managed WordPress hosting and maintenance service. Our standard package ("Pack Essential") includes:

  • A professional 1-page WordPress website built and configured for you;
  • Domain registration (.com / .net / .org / .io up to $15/year wholesale cost);
  • Managed hosting on EU-based infrastructure;
  • SSL certificate (always);
  • Daily backups with 14-day rolling retention plus offsite copy;
  • Plugin / theme / core updates (weekly maintenance window);
  • Security monitoring and uptime monitoring;
  • Content updates — text, images, prices, hours — within fair-use limits (see Section 5);
  • Email support with 24–48h business-day response target;
  • Quarterly performance review.

Specific deliverables and any agreed customizations are confirmed in the alignment conversation that precedes payment (WhatsApp / email).

2. Your account

You create an account by submitting an inquiry. We send a one-time link to set your password (24-hour expiry). You are responsible for:

  • Providing accurate information;
  • Keeping your password confidential and not sharing your account credentials;
  • Notifying us immediately at support@webance.net if you suspect unauthorized access;
  • All activity that occurs under your account, until you notify us otherwise.

We may suspend or terminate accounts that violate these Terms, with reasonable notice except in cases of urgent security or legal need.

3. Pricing & billing

Current published prices apply at the time of payment. Plans are:

  • Monthly: $49 / month, recurring monthly. Cancel any time.
  • 3-month prepaid: $132 ($44 / month equivalent), single charge.
  • 6-month prepaid: $240 ($40 / month equivalent), single charge.
  • Annual prepaid: $432 ($36 / month equivalent), single charge.

Setup fee: $0. Always.

Prices are in USD. For Moroccan bank transfers we accept the equivalent in MAD at the bank's current exchange rate.

We reserve the right to change pricing for new sign-ups at any time. Existing customers keep their original price for the duration of their current billing period and any prepaid term. We will notify you at least 30 days before applying any new price to your renewal.

3.1 Payment methods

  • Stripe (international cards) — automatic monthly charging on the monthly plan;
  • PayPal — manual one-off or subscription, as available;
  • Moroccan bank transfer (CIH Bank) — for Morocco-based customers, confirmed via WhatsApp screenshot or our online form.

3.2 Failed payments / past-due

For monthly subscriptions, we follow the payment processor's retry schedule. After 7 days past due, we may suspend the site. After 30 days past due, we may terminate the service.

For prepaid plans, your service is paid in full for the period; we will prompt for renewal 14 days before the period ends.

4. Cancellation & refunds

4.1 Cancellation

You can cancel at any time by emailing support@webance.net or via your account dashboard.

  • Monthly plan: cancellation takes effect at the end of the current paid billing period; no further charges occur.
  • Prepaid plans: the service runs to the end of the paid period. See refund policy below.

4.2 Refund policy

  • 14-day "everything works" guarantee. Within 14 days of your first paid period starting, if the site is not delivered as agreed in our alignment conversation, you may request a full refund.
  • After day 14: prepaid plans are non-refundable for the unused portion. We may, at our discretion, offer a pro-rata refund minus any setup time invested.
  • Domain registration costs (registrar fees) are non-refundable regardless of when you cancel.

4.3 Off-boarding

On termination we will:

  • Provide an export of your WordPress site (database SQL dump + uploads) so you can migrate elsewhere;
  • Transfer your domain to a registrar of your choice (auth code provided on request);
  • Retain your data for 30 days after termination, then delete in accordance with our Privacy Policy.

5. Fair use policy

Pack Essential is "everything included" for normal small- business use. To keep that promise sustainable for everyone, the following limits apply:

  • Content updates:up to 2 requests per week, ~30 minutes each. Larger work — new pages, redesigns, new features — is quoted separately as "extras" (see Section 6).
  • Updates and edits are batched into a weekly maintenance window. Urgent issues (site down, security alert) are addressed within 24 hours.
  • Excessive requests (more than 10 per month) are reviewed case by case and may incur additional fees.

6. Extras (work outside the bundle)

The following work is not included in Pack Essential:

  • New page creation: $50 / page
  • Design changes / redesign: $100–$300
  • New features / functionality: custom quote
  • Migration from another host: one-time fee, quoted
  • Custom development: $75 / hour
  • Same-day urgent fixes: $25 surcharge
  • Premium domain (>$15 / year wholesale): at cost

Extras are agreed in writing (email or WhatsApp) before work begins.

7. Acceptable use

You agree not to use Webance to host or distribute:

  • Illegal content, including pirated software, copyrighted works without permission, child sexual abuse material, or material inciting violence;
  • Content that violates third-party rights (defamation, harassment, IP infringement);
  • Malware, phishing pages, or content used in fraud schemes;
  • Pornographic or adult content, regardless of legality;
  • Cryptocurrency mining, P2P seeding, or other resource-abusive activities;
  • Spam, unsolicited bulk email, or operations that get our sending IPs blacklisted.

We will give you reasonable notice and an opportunity to remediate non-urgent violations. We may immediately suspend service for urgent security or legal issues (e.g. site actively distributing malware).

8. Intellectual property

Your content stays yours. You retain all rights to the content you provide (text, images, logo, photos) and to the design we build for you under this agreement.

Our platform stays ours. The Webance platform, our operational tools, and proprietary scripts remain our property. You get a non-exclusive right to use the service for the duration of your subscription.

WordPress + open-source components remain governed by their respective licenses (GPLv2 or later for WordPress core).

You grant us the limited right to use your business name and logo in our customer list and case studies, unless you opt out by emailing support@webance.net.

9. Service availability

We target 99.9% uptime measured monthly, excluding scheduled maintenance windows announced in advance. We do not guarantee uninterrupted or error-free service.

If monthly uptime falls below 99% for reasons within our control, you may request a service credit equal to one day per percentage point below 99%, up to a maximum of 30% of that month's fee. Service credits are the sole remedy for downtime.

10. Limitation of liability

To the maximum extent permitted by applicable law, our total liability arising out of or related to this agreement is limited to the amount you paid us in the 12 months preceding the event giving rise to liability.

We are not liable for indirect, incidental, consequential, or punitive damages — including lost profits, lost revenue, lost data beyond what backups can recover, or business interruption — even if advised of the possibility.

Nothing in these Terms limits liability for fraud, gross negligence, or anything else that cannot be excluded by applicable law.

11. Warranties

We provide the service "as is" and "as available". We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by applicable law.

We commit to providing the service in good faith, with reasonable skill, in line with industry-standard practice for managed WordPress hosting.

12. Termination

Either party may terminate at any time as described in Section 4.

We may terminate immediately, without refund, if you materially breach these Terms — including non-payment past 30 days, repeated acceptable-use violations, or fraud.

Sections that by their nature should survive termination — including Sections 8 (IP), 10 (Liability), 13 (Governing law), and 14 (Disputes) — survive.

13. Governing law

These Terms are governed by the laws of the Kingdom of Morocco. EU consumer-protection laws may grant additional rights to consumers domiciled in the EU; nothing in these Terms reduces those rights.

14. Disputes

We hope to resolve disputes informally first. If you have a concern, email support@webance.net and we will do our best to resolve it within 30 days.

If an informal resolution is not reached, disputes will be submitted to the competent courts of Casablanca, Morocco — except where consumer-protection law in your country of residence requires another venue.

15. Changes to these Terms

We may update these Terms to reflect new features, legal changes, or operational adjustments. The "Last updated" date at the top reflects the latest version. For material changes, we will notify active customers at least 30 days before the change takes effect. Continued use of the service after the effective date constitutes acceptance of the new Terms. If you do not accept, you may cancel per Section 4.
