Service Agreement

This Service Agreement (the “Agreement”) governs the subscription relationship between you (the “Customer”) and Webance, operated by Hamass El Goumri based in Morocco (“Webance,” “we,” “our,” or “us”).

By accepting this Agreement — through the button at the bottom of this page, by paying for a Webance subscription, or by continued use of Webance services — you agree to be bound by the terms below.

1. Services

Webance provides done-for-you managed WordPress hosting and maintenance under a single recurring subscription. Each Webance Essential subscription includes:

Domain registration (.com, .net, .org, or .io up to USD 15/year) included for the subscription term.
Managed EU-based WordPress hosting.
SSL/TLS certificate issuance and auto-renewal.
Daily automated backups with at least 14 days of hot retention plus offsite copies.
24/7 uptime and security monitoring.
Weekly WordPress core, plugin, and theme updates.
Up to two content update requests per week (approximately 30 minutes each).
Email support, with response targeted within 24–48 business hours.

2. Fair Use

Content updates are bundled into a weekly maintenance window so they ship predictably. Reasonable use is up to two requests per week, approximately 30 minutes each.

We reserve the right to discuss reasonable accommodation, rate-limit, or bill separately for usage that materially exceeds these limits (for example, more than ten substantial requests in a single calendar month). We will communicate any such adjustment in writing before applying additional charges.

Work outside the Essential scope — including new pages, redesigns, custom features, migrations from other hosts, and same-day urgent fixes — is billed separately at the rates published on webance.net.

3. Pricing & Billing

Subscription plans (Monthly, 3-month prepaid, 6-month prepaid, and Annual prepaid) and their amounts are those displayed on webance.net at the time you subscribe.

Prices may change for new subscribers. Existing subscribers continue at their original price for the remainder of their current commitment.

Accepted payment methods include Stripe (international cards) and CIH bank transfer (Morocco). Additional methods may be announced on webance.net.

Monthly plans renew automatically each month. Prepaid plans (3 / 6 / 12 months) are billed upfront and run for the full prepaid term.

4. Service Commencement

Services commence once (a) we receive your initial payment and (b) your site is delivered and live on your domain.

Our delivery target is 5–7 business days from receipt of all required content and assets from you. Delays caused by missing Customer assets, unresponsive Customer feedback, or third-party provisioning issues (registrar delays, payment-provider holds, etc.) extend the delivery window correspondingly.

5. Cancellation

Monthly plan: cancellable at any time. No further charges apply after the current billing period; the service continues until the end of the period already paid for.

Prepaid plans (3 / 6 / 12 months): the amount paid is non-refundable. The service continues for the full prepaid term, and you may decline renewal at the end of the term.

To cancel, email contact@webance.net or message us via your dashboard. We will acknowledge in writing.

6. Refunds

Once services have commenced (your site is live and being hosted), payments are non-refundable.

At our sole discretion, we may issue refunds in these circumstances:

Failure to deliver your site within 14 days of payment, due to our fault.
Continuous service outage exceeding 7 consecutive days, due to our fault.

Refunds, when granted, are prorated against the unused portion of the prepaid term and processed via the original payment method when feasible.

7. Intellectual Property

You retain ownership of: your content (text, images, video, copy), your domain name, and your business identity (logos, brand assets, photography you provided).

We retain ownership of: our infrastructure, proprietary code, templates, design systems, and operational methodologies. You receive a non-exclusive, non-transferable license to use them while your subscription is active.

Upon termination, you may request a full WordPress export of your site (database + uploads + theme/plugins). We provide the export within 14 business days of a written request.

8. Data Handling & Privacy

We handle your data in accordance with our Privacy Policy. Backups are encrypted at rest and retained for at least 14 days hot plus 30 days offsite. We do not share backups or credentials with third parties except as needed to operate the service (hosting provider, registrar, payment processor) or as required by law.

Customer credentials (WordPress admin passwords, database passwords) are encrypted in our admin panel using AES-256-GCM.

9. Customer Responsibilities

You agree to:

Provide accurate business information and content.
Maintain a valid payment method on file (Stripe) or honor virement obligations in a timely manner.
Respect fair-use limits.
Not use the service for unlawful, abusive, or harmful purposes, including but not limited to: spam, phishing, malware distribution, intellectual-property infringement, harassment, content prohibited under Moroccan law, or any activity that materially harms third parties.

10. Suspension & Termination by Webance

We may suspend or terminate your service in any of the following situations:

Non-payment: after a 7-day grace period past the due date, your service may be suspended (typically via WordPress maintenance mode while data is preserved). Service may be fully terminated after 30 days unpaid.
Material breach of this Agreement, including abuse, illegal activity, or significant fair-use violations after a written warning.
Force majeure events that make ongoing service delivery impossible.

Where reasonable, we provide notice and an opportunity to cure before terminating. Termination does not waive accrued amounts owed.

11. Liability Limits

To the maximum extent permitted by applicable law, Webance is not liable for indirect, consequential, special, or incidental damages, including lost profits, lost revenue, or lost data beyond what is recoverable from our backups.

Our total cumulative liability for any claim arising from this Agreement is limited to the total amount you paid us in the three (3) months preceding the event giving rise to the claim.

Webance is not liable for issues caused by force majeure events — including natural disasters, network outages outside our control, third-party provider outages, or governmental actions.

12. Disputes & Governing Law

This Agreement is governed by the laws of the Kingdom of Morocco, without regard to conflict-of-laws principles.

Any dispute arising out of or relating to this Agreement is subject to the exclusive jurisdiction of the competent courts of Casablanca, Morocco.

Before initiating any formal proceeding, both parties agree to attempt a good-faith resolution by email or WhatsApp for at least 30 days from the date of the first written dispute notice.

13. Changes to This Agreement

We may update this Agreement from time to time. Minor changes (typos, link updates, clarifications that do not materially change your rights or obligations) take effect immediately upon posting at this URL.

Material changes (changes to service scope, fair-use limits, pricing terms, refund policy, or liability provisions) are communicated to existing subscribers by email at least 60 days before the new version takes effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
